Terms of Use
Last updated:
1. Purpose
These terms govern your use of Tacktus: the iPhone and Android apps, the web app at app.tacktus.com and the website tacktus.com, published by Elhadji Ibrahima Ndiaye, an individual based in Dakar, Senegal (“we”). By creating an account, you accept them.
2. Who can use Tacktus
You must be at least 16. One account per person.
3. Your account
You sign in with a code sent to your email, or with Apple or Google. Keep access to that email address or account secure: what is done from your account is considered done by you. Keep your details accurate.
You can delete your account from the app, as described on our support page. An account with an active or disputed debt can be deleted only once that debt is settled.
4. What Tacktus does, and does not do
Tacktus is a tool for recording debts between two people and the repayments made on them.
Tacktus is not a bank, a payment service or any other financial institution. It does not hold, receive, transfer or lend money.
Amounts in Tacktus are the parties' own records. They are not proof of payment and do not commit us to anything.
5. Recording a debt
Record debts in good faith, with accurate amounts. Share an invitation link only with the person concerned: while the debt is pending, anyone holding the link can see its details.
The other person is free to confirm or decline. Until they confirm, the debt is provisional.
6. Confirmation
A debt or a repayment counts only once both people have confirmed it: the person who did not record it confirms it.
One exception: when the lender records that the full balance was repaid, it counts right away and the debt is settled. The lender can reverse that repayment for a short time afterwards, which reopens the debt, and the borrower is told.
7. Disputes between users
Tacktus provides a shared record, nothing more. We do not arbitrate disagreements between users and are not liable if someone does not repay. If you disagree with what someone recorded, do not confirm it, and sort it out with them.
8. Rules of use
Do not use Tacktus for anything illegal, to harass or mislead anyone, to record debts with people who have nothing to do with them, or to disrupt the service (unauthorised access, overload, getting around protections).
We may suspend or close an account that breaks these rules, telling you first when we can.
9. Personal data
How we handle your data is described in our Privacy Policy, which is part of these terms. When you record a debt with someone, you confirm you have a good reason to give us their name and their email address or phone number.
10. Intellectual property
Tacktus, its name, logo, design and code belong to us. You get a personal, non-exclusive, revocable right to use the app. What you record remains yours; you allow us to process it to run the service.
11. Availability and changes
Tacktus is free and provided “as is”. We work to keep it available and accurate, but cannot guarantee it at all times. We may change, suspend or end features, and will tell you in advance when we can.
12. Liability
To the extent the law allows, we are not liable for losses arising from debts between users, from money that changes hands outside Tacktus, from incorrect entries, or from the service being temporarily unavailable.
Nothing in these terms limits liability that the law does not allow us to limit.
13. Changes to these terms
We may change these terms. For significant changes, we will tell you in the app before they apply. Using Tacktus after that date means you accept them.
14. Governing law
These terms are governed by the law of Senegal. Failing an amicable solution, the courts of Dakar have jurisdiction, subject to the mandatory rules of your country of residence.
15. Contact
For any question about these terms, write to contact@tacktus.com.
